Terms of Service

1. Who we are
Klaket (klaket.io) is a service provided by Klaket. For any question, write to klaket.support@gmail.com. By creating an account or using Klaket, you accept these Terms, the Privacy Policy and the Acceptable Use Policy.
2. The service
Klaket uses artificial intelligence to create video ads, social media posts and landing pages from the photos, text and ideas you give us. Results are generated automatically by AI models and may contain errors or inaccuracies: always review content before publishing it.
3. Account
You must be at least 18 and provide accurate information. Your account is personal and non-transferable, and you are responsible for keeping your password safe and for everything done with it. Free credits are a one-time offer per person: creating multiple accounts to obtain them is not allowed, and an account created on the same device, network or email as one that already received them starts without free credits. If you delete your account, you can't create a new one with the same email.
4. Credits
Each creation (video, scenes, posts, landing page) uses credits, and the cost is always shown before you confirm. Plan credits renew every month: you get your plan's full amount and whatever is left does not carry over to the next month. Credits from packs, invites and refunds have no expiry date: they remain in the account until they are used, and are only used after your plan credits. If a generation fails for a technical reason, the credits return to your account automatically. Credits have no cash value, are non-transferable and cannot be exchanged for money.
5. Plans, payments and renewal
Prices include VAT. Payments are processed by Link (a Stripe company), which acts as the reseller and merchant of record for purchases on Klaket and issues the invoices. Plans are monthly subscriptions that renew automatically until cancelled. You can cancel at any time under “Credits & plan”: the plan stays active until the end of the period already paid and you won't be charged again. When you upgrade, you pay the prorated difference right away and receive the prorated credits; when you downgrade, the new price applies from the next renewal. If you use Klaket through the Shopify app, these payment terms do not apply: your plan is billed by Shopify on your Shopify invoice, in US dollars, and you choose, change or cancel it on the app's plan page in your Shopify admin; uninstalling the app cancels the plan.
6. Right of withdrawal and refunds
If you are a consumer, you may withdraw from a purchase within 14 days. Because credits are available immediately, by purchasing you ask for the service to start right away; if you withdraw within that period, we refund the amount corresponding to the credits you have not used. To do so, write to klaket.support@gmail.com from your account email. Outside these cases, payments already made are non-refundable, except where the law requires otherwise. For plans billed by Shopify, refunds are made through Shopify billing.
7. Your content
You warrant that you hold all rights to the photos, trademarks, logos and text you upload and that using them does not infringe anyone's rights. You keep ownership of your content and give us only the permission needed to process it, send it to the AI models and store it, solely to provide the service.
8. Outputs and AI disclosure
As long as you comply with these Terms, you may use the videos, posts and landing pages you create commercially. Videos on the free plan carry the Klaket watermark. Content is AI-generated: where the law or ad platforms require it (for example, the EU AI Act or the rules of Meta, TikTok and Google), you must label it as AI-generated. Because outputs are generated automatically, other people may obtain similar results.
9. Personas and real people
Klaket library personas are synthetic: they do not depict real people. You can use your own face or any photo you upload, and you are responsible for having the right to use it (including permission from the person pictured). Klaket checks every photo automatically and refuses minors, public figures and nudity. Outputs are AI-generated content (see section 8); photos and videos from Klaket Influencer carry that label inside the files.
10. Landing pages and leads
When you publish a landing page with a form, you are the controller of the personal data of the leads you receive and must have a legal basis to use it. Klaket acts as your processor: it stores those leads only to show them to you and email them to you, does not use them for any other purpose, protects them with appropriate security measures, uses only the providers listed in the Privacy Policy, and deletes them when you delete the page, the leads or your account. Generated landing pages include a short data-use notice next to the form.
11. Availability and changes
We do our best to keep Klaket available, but there may be interruptions for maintenance or provider outages. We may improve or change features and AI models; if a change materially reduces a paid plan, we will tell you in advance.
12. Liability
Klaket does not guarantee sales or commercial results and is not responsible for how you use the content. To the extent permitted by law, our liability is limited to the amount you paid in the previous 12 months. This limitation does not apply in cases of intent or gross negligence and does not affect the rights consumers have under the law.
13. Suspension and account closure
You can delete your account at any time under “Settings”: your subscription is cancelled and your data and credits are deleted, with no refund for unused credits. We may suspend or close accounts that breach these Terms or the Acceptable Use Policy, for example in cases of fraud, unauthorized deepfakes or unlawful advertising.
14. Changes to these Terms
We may update these Terms. For material changes, we will email you at least 15 days before they take effect; if you disagree, you can cancel before that date.
15. Affiliate programme
Since 26 October 2026, Klaket's affiliate programme runs on Hotmart, under Hotmart's terms and policies: anyone who wants to be an affiliate requests affiliation to Klaket on Hotmart and shares the link Hotmart gives them, and it is Hotmart that records the sales, calculates the commissions and pays them (amounts, timings, fees and the guarantee period are those shown on Hotmart). Klaket does not pay cash commissions and has ended its own commission programme. Klaket may refuse or cancel an affiliation in cases of spam, fake accounts, purchases through the affiliate's own link, paid ads bidding on the Klaket brand or domain, or claims Klaket does not make. Any account can share its Klaket invite link, which gives credits only, with no cash value: to the person who signs up through it and, on that person's first payment, to whoever invited them.
16. Governing law and disputes
These Terms are governed by Portuguese law, without prejudice to the consumer protection rules of the country where you live. If something goes wrong, please contact us first at klaket.support@gmail.com. You may also use a consumer alternative dispute resolution body such as CNIACC (www.cniacc.pt).
